The Foreign Account Tax Compliance Act (FATCA) is a US tax legislation which was enacted to prevent U.S. taxpayers who hold financial assets in non-U.S. financial institutions (foreign financial institutions or FFIs) and other offshore vehicles from avoiding their U.S. tax obligations.

The need of protecting and maintaining the integrity of tax systems on a global level and prevent tax evasion was exponentially increased. FATCA promotes cross border tax compliance by implementing an international standard for the automatic exchange of information related to US taxpayers.

Similarly to FATCA, the Organization for Economic Cooperation and Development (OECD) developed the Common Reporting Standard (CRS), which draws extensively on FATCA. More than one hundred (100+) jurisdictions, including Cyprus, adopted the OECD Common Reporting Standard (CRS). CRS requires the clients of all Financial Institutions in Cyprus, including Omega Funds Investments’ clients to complete and sign the relevant self-certification forms indicating among other mandatory fields their tax residency and tax identification number, as of 1 January 2016, for the first automatic exchange of information starting in 2017. Omega Funds Investment established the necessary procedures in order to be FATCA and CRS compliant.
